Mayson strengthens case to expand list of reserved legal activities
Tuesday, 26 July 2011There is a strong consumer protection justification for making the whole conveyancing process a reserved legal activity, Professor Stephen Mayson has argued in the final version of his influential report on the case for reservation. He said the “guarantee” of title registration is incomplete.

Escaping from the regulatory maze
Tuesday, 19 July 2011I suspect there is no coincidence that the Legal Ombudsman’s website is publicising its first annual report under the banner headline “Regulatory maze”. Those of you with long-ish memories may recall that this was the phrase used in 2003 by the then Department for Constitutional Affairs in the scoping study that paved the way for the Clementi reforms. Sir David himself adopted it to describe the confused regulatory infrastructure which his reforms were supposedly going to untangle.

Second will-writer body bids to regulate sector
Tuesday, 19 July 2011The Society of Will Writers has become the second trade body to announce its bid to regulate the profession if required. After the Legal Services Consumer Panel said will-writing should be regulated, the society said a system could be introduced “very quickly and cheaply with the profession bearing the bulk of the cost”.

The lessons of will-writer regulation
Friday, 15 July 2011Yesterday’s report on will-writing by the Legal Services Consumer Panel was more proof, if any were needed, that the Legal Services Act 2007 is anything but a deregulatory measure. Even the deregulation of business structures is hedged by a raft of new regulation. There are several points worth picking out of the report. First, it emphasises once more how critical reserved legal activities are to the future shape of the legal market.

Institute of Professional Willwriters throws hat into ring to regulate wills market
Thursday, 14 July 2011The Institute of Professional Willwriters (IPW) will apply to become a regulator of will-writing services should the Legal Services Board decide to make it a reserved activity, it has confirmed. It called on the board and the government “to take prompt action to implement the recommendations” of today’s consumer panel report.

LSB launches formal probe into regulating will-writing, probate and estate work

Consumers happy with lawyers’ services but don’t trust them, says survey
Tuesday, 21 June 2011The great majority of consumers who have used legal services are satisfied with the outcome, although many do not feel they received good value for money, a survey has found. Worryingly for lawyers likely to face competition from trusted brands after October, however, it suggested significant public distrust of lawyers.

In-Deed eyes up expansion into will-writing and personal injury work

SRA poised to mystery shop conveyancing firms over fees and publicity

At the same time, the Legal Services Board announced that it is to consider a major review of conveyancing.
