High Court overturns SDT fines and questions absence of sanctions guidance
Wednesday, 16 March 2011The High Court has expressed surprise that the Solicitors Disciplinary Tribunal does not publish guidance on the sanctions it might impose, in a judgment overturning fines levied against four partners at a firm where a member of staff stole over £100,000. The case should give “encouragement to those who have been poorly treated by the tribunal”, it has been claimed.

Escalating number of allegations over financial misconduct by firms, says SRA

Row over how performance of Solicitors Disciplinary Tribunal is judged

Ethics – remember them?
Thursday, 28 October 2010During my 12 years working on the Law Society Gazette, one got used to certain clichés. The plastic wrapper would come up a lot, but more than anything people would say how their favourite section was the one detailing solicitors being struck off – it was the same for me as a reader while a trainee solicitor. I felt strangely proud a few months back after recognising three people in one edition of the Gazette’s Solicitors Disciplinary Tribunal reports.

Record number of solicitors struck off
Friday, 22 October 2010There has been a 47% jump in the number of solicitors struck off and the figure is now at its highest for over a decade, the Solicitors Disciplinary Tribunal has revealed. Some 84 solicitors were removed from the roll in the year to 30 April 2010, compared to 57 in the previous 12 months. It is the highest number since at least 1999, which is the furthest back Legal Futures has been able to trace.

Big rise in solicitors struck off and firms shut
Thursday, 13 May 2010There has been a sharp increase in the numbers of law firms closed and solicitors struck off, Legal Futures has discovered. Figures from the Solicitors Regulation Authority show it intervened in 31% more firms in the year to 31 March 2010, while there was a 58% jump in strike-offs by the Solicitors Disciplinary Tribunal.

SRA given green light to fine solicitors
Tuesday, 11 May 2010The Solicitors Regulation Authority (SRA) will be able to formally rebuke solicitors and fine them up to £2,000 from next month, it has been confirmed. However, the potential conflict between the civil standard of proof that will be applied in such cases and the criminal standard used by the Solicitors Disciplinary Tribunal – which will hear appeals against SRA decisions – has not yet been resolved and is likely to require further work.

Conflict over burden of proof delays SRA’s new powers to fine and rebuke solicitors
