Solicitor suspended for failing to pay ARP premium as SRA vows crackdown

Launch of ABSs clears major hurdle
Friday, 19 August 2011Would-be alternative business structures unhappy with decisions taken by the Solicitors Regulation Authority will be able to appeal to the Solicitors Disciplinary Tribunal, it has been decided, in a significant step towards the introduction of ABSs.

File-sharing solicitors hit by SDT fine and suspension plan appeal
Tuesday, 2 August 2011Two solicitors sanctioned today by the Solicitors Disciplinary Tribunal for sending intimidating letters to individuals they accused of illegal file-sharing are set to appeal. They were fined £20,000 each and suspended from practising for three months after all six allegations against them were proven.

The ABS blame game
Monday, 18 July 2011There will no doubt be some finger pointing after our revelation today that the Solicitors Regulation Authority will not be in a position to start licensing alternative business structures on 6 October. Those with business plans worked up on the basis of 6 October will be rightly annoyed, and it hardly sends out an impressive signal.

BME solicitors still face disproportionate amount of regulatory action, SRA admits
Friday, 15 July 2011Black and minority ethnic solicitors continue to figure in a disproportionate number of regulatory actions, the Solicitors Regulation Authority has admitted. It is occuring across key areas such as interventions, referrals to the Solicitors Disciplinary Tribunal and the imposition of practising certificate conditions.

High Court ruling boosts solicitors facing hearsay evidence in disciplinary proceedings

Goodbye SDT? Legal Services Board sets sights on “rationalising” disciplinary regimes
Tuesday, 10 May 2011The Legal Services Board is considering whether to consolidate the disciplinary regimes run by all the different legal regulators, it has emerged. Recent events “suggest we should explore the feasibility of rationalising existing mechanisms sooner rather than later”.

SGM threat recedes as SRA refutes suggestions that it changed ABS stance

Criminal standard of proof in disciplinary matters “could expose clients of ABSs”
Monday, 21 March 2011Regulators of alternative business structures could expose consumers to risk if they demand an overly high standard of proof in disciplinary hearings, the Legal Services Consumer Panel has warned. Meanwhile, the Bar Standards Board is to consider switching to a civil standard of proof.
