SDT questions prosecution of solicitor with “almost 50 years of exemplary service”
Monday, 11 January 2016The Solicitors Disciplinary Tribunal has voiced “serious doubts” over whether a solicitor, aged 79 and “with almost 50 years of exemplary service”, should have been referred to it for prosecution. Reginald Hemmings told the tribunal he found the experience “extremely distressing”.

Jailed solicitor who stole from estates struck off for “disgraceful” behaviour
Monday, 21 December 2015Simon Armitage, a sole practitioner jailed for four years in October for fraud, has been struck off in his absence by the Solicitors Disciplinary Tribunal. Although the solicitor had wished to come off the roll voluntarily, it was “in the public interest” for his misconduct to be “aired before the tribunal”.

SDT unhappy with SRA again after finding that “misguided” partner did not act dishonestly over insurance
Tuesday, 15 December 2015The Solicitors Disciplinary Tribunal has again criticised the way the Solicitors Regulation Authority prosecuted a case against a solicitor, after deciding that a partner who had a “genuine but misguided” belief about the status of one of his employees had not acted dishonestly in what he told his insurer.

Former Blake Lapthorn partner agrees to leave profession over client account withdrawals
Monday, 23 November 2015A former partner at Blake Lapthorn has agreed with the Solicitors Regulation Authority that he will apply for his name to be removed from the roll after admitting five improper withdrawals of client money totalling almost £222,000. He used client money, without consent, for the benefit of another client – known as ‘teeming and lading’.

Probate manager who admitted 140 “improper withdrawals” from client accounts blamed pressure of work
Tuesday, 17 November 2015A probate manager who admitting making 140 “improper withdrawals” over a period of 11 years, resulting in a client account shortage of £730,000, has been banned from working for law firms. Though he acted recklessly, the Solicitors Disciplinary Tribunal did not find him dishonest.

Solicitor who paid clients “compensation” from his own bank account is struck off
Monday, 26 October 2015A solicitor who failed to issue proceedings, fabricated settlement offers and paid clients “compensation” from his own money has been struck off. Mark Davies told the Solicitors Disciplinary Tribunal that some clients may have benefited from his actions.

Criminal lawyer struck off after failing to report drink-driving conviction
Tuesday, 13 October 2015A criminal lawyer who failed to report a drink-driving conviction to the Solicitors Regulation Authority has been struck off by the Solicitors Disciplinary Tribunal. Gail Evans said she was aware of the need to report convictions but “panic had set in”.

SRA should not be “bargaining” with solicitors over sanctions, says tribunal
Monday, 12 October 2015There should be no question of the Solicitors Regulation Authority “bargaining” with solicitors about sanctions, the Solicitors Disciplinary Tribunal has made clear. The tribunal rejected a “suggested outcome” proposed by the SRA and a solicitor, and imposed harsher penalties.

SDT throws out allegations of forgery against fee-earner
Tuesday, 22 September 2015The Solicitors Disciplinary Tribunal has thrown out forgery charges against a non-qualified fee-earner, deciding he had no case to answer and that the Solicitors Regulation Authority should pay costs of £5,000 as a reminder to it to keep cases under review as they progressed.

SDT strikes out case against solicitors after SRA failures make fair trial “impossible”
