LSB: no ban on referral fees but publish all agreements with introducers
Wednesday, 29 September 2010The Legal Services Board (LSB) has confirmed that it does not back reinstating the ban on referral fees but said that instead all agreements between lawyers and their introducers should be published. As first reported on Legal Futures last month, the LSB said today that there is insufficient evidence to make the case for a ban, but that transparency and disclosure need to be improved. It also said there should be the same rules for the different parts of the regulated legal market so far as possible.

Consumer panel gives green light to referral fees if there is greater transparency
Wednesday, 26 May 2010Referral fees should not be banned, but require greater disclosure and more stringent regulation, the Legal Services Consumer Panel has concluded. This could include conveyancing clients providing written consent to be referred and a ban on auctions for work.

Is the referral fee debate over?
Tuesday, 18 May 2010As we reported yesterday, the results of the economic impact analysis commissioned by the Legal Services Board concluded that the consumer does not suffer any detriment. The hard truth is that if they are not distorting the market, the argument to ban them is hard to maintain. But I am not entirely convinced by the research. The conclusions that the researchers, Charles River Associates, came to on the basis of the evidence before them seem fair enough. What bothers me slightly is whether they really sought enough evidence. It feels a touch superficial to me.

Jackson assessor casts doubt on likelihood of referral fee ban
Wednesday, 28 April 2010One of Lord Justice Jackson’s own assessors – the Senior Costs Judge, Peter Hurst – has cast doubt on the judge’s recommendation that referral fees be abolished, it has emerged. The news comes ahead of two influential reports examining referral fees that are to be published next month.

Index to measure success of legal reforms
Tuesday, 30 March 2010A ‘Consumer Welfare Index’ that will measure the effectiveness of the legal services reforms is to be developed by the Legal Services Consumer Panel, it announced today (30 March). The panel will also look to help price comparison websites operate properly in the legal market.
