Government holds firm against Jackson changes
Thursday, 15 September 2011The government has fought off amendments to the Legal Aid, Sentencing and Punishment of Offenders Bill that would have reversed the impact of the Jackson reforms on several areas of practice. It has also rejected the judge’s recent call to fund expert reports in clinical negligence cases with legal aid.

Clarke: paying referral fees likely to be criminal offence
Wednesday, 14 September 2011The ban on referral fees is likely to take the form of a criminal offence, Lord Chancellor Ken Clarke revealed yesterday. Meanwhile, Jack Straw has called for the fees payable to lawyers under the road traffic accident portal to be halved to £600.

RTA portal beats predictions with 630,000 claims
Friday, 5 August 2011The RTA claims portal processed around 25% more claims than anticipated during its first year of operation – with more than 630,000 claims submitted to compensators – as the system’s behaviour committee prepares to approach regulators to help stamp out bad practice by users.

CJC warns of MoJ threat to access to justice as Jackson implementation role is revealed
Thursday, 4 August 2011Government plans to reduce the amount of litigation in the county courts by introducing mandatory pre-action directions will undermine the constitutional principle of access to the courts, the Civil Justice Council (CJC) has warned. The news comes as the CJC’s role in implementing the Jackson reforms has also been revealed.

RTA portal struggles with claim numbers as clinical negligence pilot is set for April
Thursday, 28 July 2011The RTA portal received around 650,000 claim notification forms during its first year of operation, although problems with the system means it is not clear exactly how many claims were lodged. Meanwhile, a pilot to fast-track clinical negligence claims is set to begin next April, it has emerged.

Claims management companies see income soar to £581m

Personal injury bucks double-digit slump in civil litigation
Thursday, 7 July 2011Low-level personal injury claims bucked the trend that saw a dramatic double-digit dip in the volume of civil litigation during 2010, Ministry of Justice figures have shown. The 2010 statistics show an almost universal fall in the volume of work going through all levels of UK civil courts last year.

The tangled web of referral fees
Wednesday, 29 June 2011The furore over referral fees has come out of nowhere. In the past three weeks, the Sunday Times, the Daily Mail, the Sunday Telegraph and, this week, The Times with the help of Jack Straw, have all climbed into the trade in claims. There has been an increasing focus on the role of insurance companies – referral fees’ most vehement critic – in actually fuelling them, which has certainly put the industry on the spot. The “if we don’t do it, everyone else will” argument put forward by the Association of British Insurers is not exactly an attractive one.

Seriously injured and disabled could suffer under Jackson reforms, MPs warn
Tuesday, 28 June 2011The Jackson reforms could “impact negatively on some of the most seriously injured or disabled claimants”, an influential committee of MPs has warned. It also called for a review of the regulation of claims management companies amid concerns about their role in clinical negligence claims.

Consumers happy with lawyers’ services but don’t trust them, says survey
Tuesday, 21 June 2011The great majority of consumers who have used legal services are satisfied with the outcome, although many do not feel they received good value for money, a survey has found. Worryingly for lawyers likely to face competition from trusted brands after October, however, it suggested significant public distrust of lawyers.
