Breathing space for PI lawyers? Reforms unlikely to have impact until 2018

Personal injury CMCs see income tumble by 30%
Tuesday, 26 July 2016The turnover of personal injury claims management companies (CMCs) tumbled by 30% in the past year, it was reported today. The figures also showed that the number of CMCs in the PI market has fallen by nearly two-thirds since the referral fee ban was introduced in 2013.

Personal injury lawyer who faced “perfect storm” is struck off
Monday, 11 July 2016A personal injury lawyer who faced “what could almost be described as a perfect storm” of legal aid cuts and a doubling of his rent has been struck off by the Solicitors Disciplinary Tribunal. The SDT said that rather than approaching his bank, the solicitor took a decision to “plunder client account”.

Here come the loss adjusters: US giant to launch ABS
Thursday, 16 June 2016Crawford & Company, one of the world’s biggest firms of loss adjusters, has announced that it is setting up an alternative business structure in the UK to offer an end-to-end claims management services. Crawford – which is listed on the New York Stock Exchange – has 27 offices in this country.

ICO investigates after medical records found in skip outside law firm
Thursday, 16 June 2016The Information Commissioner’s Office has launched an investigation, after medical records relating to personal injury claims were found in a skip outside a law firm’s former office in St Helens, Merseyside. Separately, evidence has emerged of bodyshops releasing personal data to third-party law firms and CMCs.

Not about the money: personal injury firm to open City “client knowledge hub”
Thursday, 9 June 2016Defendant personal injury firm BC Legal is launching an unusual “client knowledge hub” in the City next month, which will provide a range of free services but “very little fee-earning”. It said the hub would offer training, software demonstrations and free access to meeting rooms, a roof terrace, a gym and a hotel.

DAS Law launches graduate academy as staff numbers top 200
Friday, 6 May 2016DAS Law – the alternative business structure set up by the eponymous legal expenses insurer – is launching a pioneering graduate academy for “lawyers of the future”, with the first six recruits starting next month. Staff numbers at the firm have doubled to around 220 since it was created in 2013.

APIL to launch campaign against CMC cold-calling
Thursday, 5 May 2016The Association of Personal Injury Lawyers is set to launch a campaign to persuade the government to ban claims management companies from cold-calling consumers over potential claims. ‘Can the spam’ is part of the push to convince ministers that there are other ways of tackling problems in the PI industry short of the reforms it is proposing.

Directors of collapsed firm admit allowing client account to be used as banking facility
Monday, 21 March 2016Two directors of collapsed Devon law firm Recompense, Carolyn Hales and Irene Webb, have admitted allowing its client account to be used as a banking facility following agreements with the Solicitors Regulation Authority. Matthew Roddan, a third director of the firm, is on his way to the Solicitors Disciplinary Tribunal.

Budget: Government to beef up CMC regulation with switch to FCA oversight
Wednesday, 16 March 2016The regulation of claims management companies is to move to the Financial Conduct Authority as part of a major shake-up that will see all CMCs have to seek reauthorisation and subject to an additional levy to fund the transition.
