CMCs rake in over £6bn in past 10 years of regulation
Thursday, 20 July 2017Claims management companies have earned over £6bn in the past decade, new figures from the Claims Management Regulator have shown. In a special anniversary report to mark 10 years of regulation, the CMR said that the number of CMCs had shrunk from a peak in 2011 of 3,213 to 1,388 in 2017.

Government to press ahead with raising PI small claims limit as ABI figures show motor fraud is falling
Wednesday, 19 July 2017The Ministry of Justice has confirmed that the Civil Liability Bill will, as expected, include rises in the small claims limit for personal injury claims and a fixed tariff for compensation as a former Goldman Sachs banker has been given responsibility for steering it through the House of Commons.

Holiday sickness battle hots up with both claimants and defendants celebrating court victories
Thursday, 13 July 2017A couple who became ill after a holiday in Egypt have won what it is believed to be the first court victory since the appeal judges’ ruling in Wood v TUI Travel at the start of this year. But, at the same time, Thomas Cook has claimed a victory of its own by winning a declaration that two claimants had been fundamentally dishonest in their sickness claims.

Government to introduce fixed costs for holiday sickness claims amid row over tour operator approaching lawyers’ clients
Monday, 10 July 2017The government is to impose fixed recoverable costs for holiday sickness cases as war is breaking out over letters that a leading holiday operator is sending directly to claimants even if they already have solicitors. However, Jet2holidays has told Legal Futures that the letters have generated responses from holiday makers unaware that a claim had been made on their behalf.

Leading travel company claims victory over law firm’s ‘bogus’ holiday sickness cases

Government PI reforms will push 80% of RTA cases into small claims court, research finds

Personal injury firm loses £4.5m claim that work referrer did not deliver cases it promised
Wednesday, 28 June 2017A personal injury law firm has lost a £4.5m claim against a legal expenses insurance underwriting agency that the expected number of referrals did not materialise. The firm failed to convince the High Court that there was a contractually binding oral promise in place from 2006 to 2011, when referral fees were lawful.

Queen’s Speech: Government to press ahead with PI reform and court modernisation
Wednesday, 21 June 2017The government is to reintroduce its personal injury reforms, it was confirmed this morning in the Queen’s Speech, provoking fury among claimant lawyers. What was the Prisons & Courts Bill will not be reintroduced but there is to be both a Civil Liability Bill for the PI changes and a Courts Bill to progress court modernisation.

Clerk who pursued PI claims against wishes of clients banned by SDT
Friday, 16 June 2017A clerk who pursued personal injury claims against the wishes of his clients has been banned from working for law firms by the Solicitors Disciplinary Tribunal. Michael Davis said he was acting “in accordance with office procedures” and was managing up to 400 live cases at any one time.
