Court of Appeal criticises firms that persuade clients to bring PI undersettlement claims
Tuesday, 5 September 2017The Court of Appeal has criticised law firms which attract clients through adverts which suggest their previous solicitors may have undersettled personal injury claims. It also said there should be “a sensible limit” on what should be expected of a solicitor operating on a fixed fee in a “high volume, low cost commoditised scheme”.

Paralegal wins employment tribunal claim for £14,000 bonus from personal injury firm
Tuesday, 5 September 2017A paralegal employed by a personal injury firm under an oral contract was entitled to a bonus payment worth almost £14,000, an employment tribunal has ruled. The judge said the firm could not unilaterally vary the contract that entitled the paralegal to up to 10% of profit costs above a target set at five times his gross salary.

With PI reforms looming once again, how can firms adapt to survive?
Wednesday, 30 August 2017Back in November, a survey showed that more than half of claimant personal injury (PI) law firms would be forced to shut down or look for other work if the government’s proposed reforms go through. Since then, the reforms were dropped, before being put back on the agenda after the election as part of the new Civil Liability Bill. The uncertainty surrounding this contentious issue has meant that, understandably, many firms operating within the PI sector are nervous about the future. The natural reaction from many has been to reduce spending across all areas of the firm to ensure reserves are significant enough to ride out the storm when it hits. But is this simply accepting defeat?

SRA warns law firms and CMCs over excessive PPI fees

CMC that encouraged false holiday sickness claims thrown out by regulator
Tuesday, 29 August 2017A firm responsible for pressuring people into making holiday sickness claims had its licence cancelled by the Claims Management Regulator last week. It had encouraged holiday-goers to fabricate or embellish symptoms of gastric illness to get compensation.

Injury Prevention Day and the agenda for reform
Wednesday, 16 August 2017This year APIL’s Injury Prevention Day falls as we anticipate a return of the Civil Liability Bill in the upcoming parliamentary session, as well as the resurrection of plans to increase the small claims court limit. APIL originally instigated Injury Prevention Day in 2015 on the third Wednesday of August as an occasion to highlight what our association is about, and to give people a better understanding of our values. A key part of APIL’s remit is to promote safety standards and reduce avoidable harm. This year, Injury Prevention Day and the agenda for reform are connected.

Number and turnover of personal injury CMCs continues to tumble
Monday, 7 August 2017The turnover of personal injury claims management companies (CMCs) has continued to tumble over the past year, falling 41% in just two years to £182m, according to the Ministry of Justice, which also highlighted how CMCs that offer damages-based agreements are struggling to comply with the law.

Bogus CMC owner jailed for seven years over ‘crash for cash’ scams
Thursday, 3 August 2017A man who set up two fraudulent claims management companies and another who helped him stage car crashes have been sentenced to more than 10 years in prison between them. The City of London Police has thanked the solicitors targeted by the fraudulent referrals for their co-operation.

Partner struck off after settling PI claim for £5,000 then paying client £60,000 in fictitious damages

Senior judge berates government lawyers over handling of MoJ negligence claim
Tuesday, 25 July 2017A lady justice of appeal has berated the Government Legal Department over its defence of a negligence claim brought by a prison officer against the Ministry of Justice, saying its “lack of focus” led to a “huge workload which was wholly disproportionate to the real issues”.
