Competition heats up in PI as firms look to survive upcoming reforms, survey finds

Advertising spend and costs were spiralling upwards both online and on TV as firms look to grab greater shares of the market.

Pockets of poor practice as SRA issues revised PI warning notice
Friday, 15 December 2017There is still some bad practice among personal injury firms – particularly around their relationships with work introducers and other third parties – but overall it is a positive picture of good practice and compliance, the Solicitors Regulation Authority’s has found. It also suggested that the low level of reported fraud was because defendant firms chose to opt for a discontinuance rather than press the issue.

Government confirms intention to introduce CMC cold-calling ban
Monday, 27 November 2017The government has emphasised its intention to introduce a ban on cold-calling by adding it to the long title of the parliamentary bill that will bring the ban about. The news comes as the bill has been amended to cap at 20% the fees CMCs and lawyers can charge consumers for claims management services in relation to PPI claims.

Budget documents indicate that whiplash reform is “coming soon”
Friday, 24 November 2017The government’s whiplash reforms will have to be published soon to meet Treasury forecasts published with Wednesday’s Budget, a leading insurance law firm has suggested. BLM said the material “appears to indicate that government expects to implement these reforms before April 2019”.

Court of Appeal to hear PI firm’s £4.5m claim over referrals it did not receive

Policeman jailed for selling crash data to claims firm – which were sold on to law firms
Wednesday, 8 November 2017Two married constables working for Lancashire Police were sentenced last month for stealing police data about car crashes and selling it to claims firms for £363,000. An investigation was launched after people complained they were getting calls from law firms when they had not given their details to anyone other than the police.

Government in unexpected u-turn on CMC cold-calling ban
Friday, 27 October 2017The government has unexpectedly reversed its opposition to a ban on cold-calling by claims management companies. Minister Baroness Buscombe said: “We have already committed to ban cold calls relating to pensions, and are minded to bring forward similar action in relation to the claims management industry.”

Solicitor rebuked for beginning PI claims without checking details of referred clients
Friday, 27 October 2017A personal injury lawyer has been sanctioned for launching claims without checking that the details he received from a claims management company were correct. Taher Zia Shad has accepted a rebuke and £2,000 fine, the most the Solicitors Regulation Authority can do without referring him to a tribunal.

Lidington confirms rise in small claims limit for personal injury cases
Wednesday, 25 October 2017The small claims limit for RTA cases will rise to £5,000 – as they are not cases where people should usually need a lawyer – and the limit for other personal injury cases to £2,000, the justice secretary, David Lidington, confirmed today. But he could not say when. He also said the government would make an announcement in the “very near future” on its review of LASPO.

Claims management regulator bids to stem unauthorised businesses
Monday, 23 October 2017The Claims Management Regulator has stepped up its focus on businesses operating without authorisation, particularly those in the holiday sickness market, after receiving more than 200 complaints in just three months. It prosecuted one company earlier this month, resulting in a £40,000 fine.
