Solicitor, paralegal and others face contempt of court trial over “inflated” PI claim
Thursday, 1 February 2018A solicitor, paralegal, GP and claims management company owner are all set to face committal proceedings for contempt of court shortly over an alleged fraudulent personal injury claim. The High Court this week approved further grounds for the committal, taking the total to 40.

Rebuke for law firm that paid £215,000 for referrals from unauthorised CMC
Wednesday, 31 January 2018A north-west law firm has been rebuked after paying more than £200,000 to an unauthorised claims management company for personal injury referrals. The Solicitors Regulation Authority has been dogged by questions over the effectiveness of its response to the ban on PI referral fees since it became law in 2013.

Looking for new answers in PI
Tuesday, 23 January 2018It might be a New Year with a new justice secretary, but there’s work to do if 2018 isn’t going to result in the same old story when it comes to legal reform. In recent times the personal injury sector has been hit by a battery of changes, and all-too often our response has been unclear or even apologetic. Yet the cumulative impact on our firms and especially on those we seek to assist has been obvious. It is time we learned from our experiences and tried a different approach.

Government accused of “pulling its punches” over PI cold-calling ban
Tuesday, 23 January 2018The government was accused yesterday of “pulling its punches” and “shilly shallying” over introducing a ban on cold-calling for personal injury claims. The comments came after work and pensions secretary Esther McVey appeared to fudge the commitment the government had previously given in the House of Lords.

Regulator cracks down on unauthorised holiday sickness CMCs as cold-calling ban reaches Commons

“Living in a fantasy land” – claimant PI lawyers attack minister’s evidence to MPs

Lord Keen: Greater involvement by CMCs “beneficial” for personal injury market
Tuesday, 16 January 2018Justice minister Lord Keen said today that if the government’s personal injury reforms lead to greater involvement by “good” claims management companies, it could be “beneficial” for the market. He told MPs on the justice select committee this morning that the market was “extremely adaptable and flexible”.

Small claims 2013 v 2018: What has changed?
Monday, 15 January 2018Successive governments have considered increasing the small claims limit for personal injury claims, at the behest of the insurance industry lobby, from £1,000 to £5,000. But the lower limit remains unchanged because, so far, evidence and reasoning have prevailed. The last time the government tried to implement an increase was in 2013 when it concluded that it would keep the issue under consideration for implementation “when appropriate”. Nothing has happened to suppose a small claims limit of £5,000 is any more “appropriate” in 2018 than it was in 2013.
