Law firms dealing with insurance products given breathing space over new rules

‘No, minister – CMCs are not the answer to your problem’
Thursday, 22 February 2018Last month, MPs on the justice select committee asked minister Lord Keen what would happen when the government went ahead with its plan to raise the small claims limit for personal injury claims (from £1,000 to £5,000 for road traffic related claims and to £2,000 for everything else). As it is a jurisdiction in which lawyers do not generally operate – because legal costs are not recoverable – who might help claimants navigate what can still be a complex process? His answer, surprisingly, was claims management companies.

Asons boss set for tribunal on charges including illegal referral fees and inflated costs
Friday, 16 February 2018The principal solicitor of controversial Bolton personal injury firm Asons is to appear before the Solicitors Disciplinary Tribunal over multiple allegations, including the payment of illegal referral fees and false costs claims, the Solicitors Regulation Authority has confirmed.

SRA receives 300 complaints in two years about PI firms paying referral fees or cold-calling
Wednesday, 14 February 2018The Solicitors Regulation Authority received nearly 300 reports of personal injury (PI) law firms either paying illegal referral fees or being involved in cold-calling, it has revealed. This is in the context of there being only 768 ‘specialist’ law firms, which the Solicitors Regulation Authority defines as generating at least half their turnover from PI work.

The countdown begins: Whiplash reforms to be introduced in April 2019
Monday, 12 February 2018The government plans to introduce its whiplash reforms in April 2019, it emerged today. The Motor Accident Solicitors Society said it has today been told that ministers have agreed for the personal injury reforms to be implemented from that date, with an initial focus on RTA.

Repair company employee convicted for passing on customer details for PI cold calls
Friday, 9 February 2018A former worker at an accident repair firm who downloaded and sold the personal data of motorists to nuisance callers has been convicted under the Data Protection Act of unlawfully obtaining and disclosing data. Meanwhile, a barrister has been reprimanded after leaving documents on the London Underground.

Extend PPI fee cap to personal injury claims, insurance lawyers demand
Thursday, 8 February 2018Insurance lawyers’ call for the government to extend the fee cap to be imposed on PPI cases to personal injury claims ahead of the whiplash reforms fell on deaf ears this week. CMCs specialising in PPI have separately warned the government that the cap could “destroy” their industry.

Government presses ahead with cold-calling ban despite criticism of approach
Wednesday, 7 February 2018The government yesterday rejected criticism that its proposed ban on cold-calling did not go far enough and voted it into the Financial Guidance and Claims Bill. A minister said it was “convinced that the new clause will have the effect of making unwanted calls from claims management services unlawful”.

Government accused of “breaking promise” on cold-calling ban as it targets April for holiday sickness fixed fees
Tuesday, 6 February 2018Claimant solicitors and defendants have come together to attack the government’s proposed ban on cold-calling, with the Association of Personal Injury Lawyers describing it as a “broken promise”. ABTA joined the criticism as it emerged that the addition of holiday sickness claims to the fixed recoverable costs scheme is scheduled to come into force in April.

Suspension for solicitor whose firm pursued PI claims without instructions and paid referral fees
Friday, 2 February 2018The owner of a Manchester law firm which pursued personal injury cases without the consent of clients and also paid prohibited referral fees has been suspended for three years. His misconduct was “shocking and outrageous and had a significant adverse impact on the reputation of the profession”, according to the Solicitors Disciplinary Tribunal.
