CMCs that want to advise and represent clients “will need to prove competence”, says Treasury

Government and Labour to keep talking on details of CMC cold-calling ban

The Financial Guidance and Claims Bill had its report and third reading earlier this week with the two sides yet to agree on whether the government’s proposed ban goes far enough.

Opposition to Civil Liability Bill steps up as peers prepare for first debate

Government “unlikely” to hit April 2019 target for PI small claims limit as solicitor warns of “have a go” culture

Justice minister uncompromising on whiplash reforms and says more fixed costs are on the way
Tuesday, 17 April 2018Justice minister Lord Keen today set the stage for next week’s House of Lords debate on the Civil Liability Bill with an uncompromising message that there are “too many unmeritorious whiplash claims made each year which proceed without challenge or investigation”. He also made clear the government’s intention to extend the application of fixed recoverable costs.

CMC which “rented” its authorisation to personal injury marketing company fails to overturn ban
Tuesday, 17 April 2018A claims management company has failed to overturn the cancellation of its authorisation, which was found to have been “rented” to a marketing company which operated a call centre to generate personal injury leads. A judge said it was conducting “no business of its own” when the Claims Management Regulator intervened.

Government to introduce fixed costs for holiday sickness claims “in coming weeks”
Friday, 13 April 2018The Ministry of Justice has met its timetable to introduce fixed recoverable costs for holiday sickness claims, announcing today that they will come into effect “in the coming weeks” and before the summer holiday season. It also for the first time put concrete figures to the widely quoted statistic that sickness claims have increased by 500% in recent years.
