Government makes some concessions on Civil Liability Bill but defeats bid to remove damages tariff
Wednesday, 13 June 2018The government yesterday fought off efforts in the House of Lords led by former Lord Chief Justice Lord Woolf to remove the new compensation tariff that will govern whiplash injuries, although it has agreed that the Lord Chancellor should consult the Lord Chief Justice when setting it, in one of a series of relatively minor concessions.

Let battle commence: Labour, Lib Dems and top judges bid to reduce impact of whiplash reforms
Tuesday, 12 June 2018Opposition peers and leading legal figures will today try and curb the government’s whiplash reforms as the Civil Liability Bill enters its crucial report stage. Following last month’s committee stage, during which amendments probed the government’s thinking but were not pushed to a vote, this is the day when peers will make changes to the bill, if at all.

KPMG hit with £3m fine for Quindell audit failures
Monday, 11 June 2018Big Four accountant KPMG has been reprimanded and fined £3.15m by the Financial Reporting Council after admitting misconduct in its auditing of former personal injury alternative business structure Quindell. William Smith, KPMG’s ‘audit engagement partner’, was fined £84,000 after an investigation lasting nearly three years.

Public opposed to government’s personal injury reforms, survey finds
Friday, 8 June 2018Four in five motorists do not think it is likely that their insurer will cut premiums after saving more than £1bn under the government’s personal injury (PI) reforms. A similar number would not know what to do if the reforms forced them to pursue a PI claim on their own.

Top holiday sickness firm among 27 facing SRA probe amid claims “the bubble has burst”
Thursday, 7 June 2018A law firm that topped the table for holiday sickness claims is among 27 claimant firms being investigated by the Solicitors Regulation Authority, it has emerged. A leading defendant solicitor said he was surprised to see the firm heading the list, because it was “not one we had pretty much ever heard of”.

Could self-serve technology give barristers a way back into PI?
Thursday, 7 June 2018While discussing the Claims Liability Bill in the House of Lords last month, Conservative Baroness Berridge, a former barrister, voiced her concerns. She argued that, while the bill may well support the government’s aim of reducing fraudulent personal injury claims, this could be at the expense of those most vulnerable, the claimants themselves. “It is a high burden on your Lordships’ House to ensure that the bill hits the target of fraudulent claims as accurately as it can without the shrapnel hitting genuine claimants,” she said. There is good reason for her to be apprehensive.

The Civil Liability Bill
Wednesday, 6 June 2018Compensation claims, particularly for minor injuries as a result of road traffic accidents, are the centre of ongoing tension between the insurance industry and those who represent claimants. The Civil Liability Bill aims to put an end to what the government sees as the high number of “minor, exaggerated and fraudulent claims for compensation resulting from whiplash injuries sustained in road traffic accidents”.

FCA unveils beefed-up regulatory regime for claims management companies
Wednesday, 6 June 2018The Financial Conduct Authority has set out the more stringent regime it intends to apply to claims management companies when it takes over their regulation on 1 April 2019. A consultation on its new rules said that “when working well, CMCs can provide useful services for customers”, but it also identified several “harms” to consumers.

Here we go again – Government renews bid to make directors personally liable for nuisance calls

The announcement yesterday generated big tabloid headlines, but in fact the government made the same one more than 18 months ago but did not act on it.

Website aims to help cyclists pursue personal injury claims without lawyers
