OFT opposes will-writer regulation, while banks seek exemption from any new regime
Tuesday, 4 January 2011The Office of Fair Trading (OFT) is opposing the regulation of will-writers, saying it may well be disproportionate and unnecessary. It has also emerged that the OFT is working with the Solicitors Regulation Authority and Institute of Professional Will-writers to improve advice to consumers on executor services.

SRA and BSB set to launch “legal services stakeholder network”

Bar regulator attacks LSB for overlooking risk of abuse in lawyer-to-lawyer referrals

Will-writers a bit worse than solicitors as charities highlight shoddy wills
Monday, 13 December 2010Half of charities have experienced a poorly drafted will from a will-writer, a new survey has revealed – but a third have also seen shoddy work from a solicitor. A survey of over 50 charities by Remember A Charity found unanimous support for regulation of the will-writing sector.

LSB to 'mystery shop' solicitors and will-writers

No decision on will-writer regulation until 2012
Wednesday, 8 December 2010A decision by the Legal Services Board (LSB) on whether will-writing should become a regulated activity will not be made until 2012, it emerged today. The LSB’s draft business plan 2011/12, published today for consultation, revealed that the board is also considering what it calls a “deep dive” investigation of conveyancing.

Consumers welcome quality assurance for advocates but say scheme has big failings
Friday, 12 November 2010Mandatory quality assurance for criminal advocates is welcome but the scheme currently proposed by the legal profession falls short in several significant ways, the Legal Services Consumer Panel said today. Among the problems are a failure to consider consumer needs, weaker standards than had been consulted on, and allowing advocates to choose which cases they are assessed on.

Consumer panel calls for five-yearly “MOT” for lawyers
Thursday, 11 November 2010There is a strong case for some lawyers facing periodic reaccreditation and for creating a single badge to help consumers distinguish between regulated and unregulated providers, the Legal Services Consumer Panel said in a report published today. Responding to a request from the Legal Services Board for consumer perspectives on quality, the panel drew on consumer research it commissioned and found support for lawyers undergoing “a regular MOT”.

Independence day
Tuesday, 9 November 2010This is a blog I didn’t expect to write. We all know the independence of the legal profession from government is robust, right? In the summer I was speaking to Carolyn Lamm, the then president of the American Bar Association, about alternative business structures. When I asked if we had covered all of her concerns, she surprised me by raising the independence issue.

Hayter: independence of legal profession from government under threat
Monday, 8 November 2010The independence of the legal profession from government is under threat from Whitehall, Legal Services Consumer Panel chairwoman Dr Dianne Hayter warned on Saturday. Speaking at the Bar Council annual conference, Dr Hayter revealed that the Legal Services Board (LSB), Legal Ombudsman and consumer panel have all been told to close their websites, while she highlighted the threat from legislation that will allow government to abolish or amend the terms of the LSB.
