OFT opposes will-writer regulation, while banks seek exemption from any new regime
Tuesday, 4 January 2011The Office of Fair Trading (OFT) is opposing the regulation of will-writers, saying it may well be disproportionate and unnecessary. It has also emerged that the OFT is working with the Solicitors Regulation Authority and Institute of Professional Will-writers to improve advice to consumers on executor services.

ABSs to face fines of up to £150m
Friday, 24 December 2010Alternative business structures face a fine up of to £150 million for misconduct or non-compliance, with a figure of £50 million for individuals working within them, under plans released by the Legal Services Board (LSB). The LSB said such large figures “will have strong deterrence in the market and avoid situations where any entity or individual may consider ‘pricing in’ non-compliance”.

Sunday, 19 December 2010We all know where the Bar stands on referral fees – both the Bar Council and Bar Standards Board (BSB) strongly oppose their existence and have not been slow to express their views publicly. At last week’s meeting of the BSB’s full board, there seemed amazement that anyone could support them. Certainly the BSB’s response to the Legal Services Board’s consultation on referral fees has moved the rhetoric up a notch.

Bar regulator attacks LSB for overlooking risk of abuse in lawyer-to-lawyer referrals

Row over how performance of Solicitors Disciplinary Tribunal is judged

Will-writers a bit worse than solicitors as charities highlight shoddy wills
Monday, 13 December 2010Half of charities have experienced a poorly drafted will from a will-writer, a new survey has revealed – but a third have also seen shoddy work from a solicitor. A survey of over 50 charities by Remember A Charity found unanimous support for regulation of the will-writing sector.

No decision on will-writer regulation until 2012
Wednesday, 8 December 2010A decision by the Legal Services Board (LSB) on whether will-writing should become a regulated activity will not be made until 2012, it emerged today. The LSB’s draft business plan 2011/12, published today for consultation, revealed that the board is also considering what it calls a “deep dive” investigation of conveyancing.
