SRA indemnity reforms will drive some firms out of business, says Law Society
Wednesday, 8 December 2010Solicitors Regulation Authority plans to exclude financial institutions from the requirement for compulsory professional indemnity insurance will drive some conveyancing firms out of business, the Law Society has claimed. The longer-term move to remove work for all commercial clients from the scope of the minimum terms and conditions of cover would be short-sighted, it adds.

Confidentiality clash looms as government eyes lawyer lobbyist regulation
Tuesday, 7 December 2010The Law Society is preparing for a government push to make law firms which engage in lobbying work breach confidentiality by making them disclose details of their clients. Last month Deputy Prime Minister Nick Clegg confirmed the Coalition will legislate in 2011 to introduce a statutory register of lobbyists.

Law Society to aid compliance officers facing personal exposure under SRA’s new regime

Ombudsman warned over “chilling effect” on lawyers of publishing complaints records
Wednesday, 1 December 2010Lawyers have warned the Legal Ombudsman (LeO) that some clients will end up unrepresented if he adopts a complaints process that involves ‘naming and shaming’. Fear of reputational damage would have a chilling effect on taking on clients perceived to be ‘risky’ and adversely impact on lawyers whose social conscience led them to offer help, they said.

Legal Services Board to probe just how independent SRA is from the Law Society
Tuesday, 30 November 2010The Legal Services Board (LSB) is set to probe how independent the Solicitors Regulation Authority truly is from the Law Society. In letters to both bodies, LSB chief executive Chris Kenny said its focus would be on ensuring that “independent regulation is being delivered in practice”.

Insurers to explain risk factors as more evidence of discrimination surfaces
Thursday, 25 November 2010Professional indemnity insurers are to provide guidance for solicitors on the way the risk they pose is assessed as part of a push to ensure there is no discrimination in the renewal process. Following a meeting called by the Equality and Human Rights Commission, the Association of British Insurers also agreed to work with its members to review their proposal forms and the underpinning criteria used to assess risk, and review and report on the equality and diversity work undertaken by their members.

BSB to toughen up equality rules as research shows solicitors have a way to go too
Monday, 22 November 2010Concerns over a worsening diversity picture at the Bar have prompted the Bar Standards Board to consider making aspects of its guidelines on diversity mandatory. The news came as research published by the Law Society showed that significant obstacles still face women and ethnic minorities in accessing the upper reaches of the solicitors’ profession.

LSB to take on £110,000 cost of supervising immigration advisers

Lenders “dislike” separate representation of borrowers but investigate guidance
Wednesday, 10 November 2010The Council of Mortgage Lenders has launched an investigation into the impact of more borrowers and lenders having separate legal representation as lenders continue to restrict their panels, it has emerged. It has also given a cautious welcome to the Law Society’s new conveyancing quality scheme and sounded a warning over suggestions that the requirements of solicitors’ professional indemnity insurance will be relaxed.
