Government holds firm against Jackson changes
Thursday, 15 September 2011The government has fought off amendments to the Legal Aid, Sentencing and Punishment of Offenders Bill that would have reversed the impact of the Jackson reforms on several areas of practice. It has also rejected the judge’s recent call to fund expert reports in clinical negligence cases with legal aid.

Clarke: paying referral fees likely to be criminal offence
Wednesday, 14 September 2011The ban on referral fees is likely to take the form of a criminal offence, Lord Chancellor Ken Clarke revealed yesterday. Meanwhile, Jack Straw has called for the fees payable to lawyers under the road traffic accident portal to be halved to £600.

Retain legal aid for clinical negligence, urges Jackson – with swipe at the Law Society
Tuesday, 6 September 2011Lord Justice Jackson yesterday called on the government not to withdraw legal aid from clinical negligence work. He also criticised the Law Society for conducting a single campaign against the legal aid cuts and his reforms of civil costs “as if they are a composite package”.

Big retailers join Jackson lobbying group as MPs resume scrutiny of reforms
Monday, 5 September 2011The war of words over the Jackson reforms restarted today ahead of MPs resuming scrutiny of the Legal Aid, Sentencing and Punishment of Offenders Bill tomorrow. The Association of British Insurers has put together a ‘consortium for compensation reform’ made up of 16 leading retailers and business groups.

Rule committee approves three costs pilots and reverses controversial Carver ruling
Tuesday, 23 August 2011There will be three different costs pilots running from this autumn as the impact of the Jackson report spreads, the Civil Procedure Rule Committee has decided. It has also accepted the report’s recommendation to reverse the Court of Appeal’s highly controversial Carver ruling.

Litigation funding code heads for October approval after years of argument
Monday, 8 August 2011A code of conduct that aims to add stability and credibility to the market for third-party litigation funding could be agreed in less than three months after four years of stalled progress, Legal Futures can reveal. The Civil Justice Council has drafted in Irwin Mitchell senior partner Michael Napier to chair the working party that has been trying to draft a code since 2007.

NHS pays out £94m more to lawyers on both sides as costs bill tops £250m
Monday, 8 August 2011The NHS Litigation Authority paid out £195m in costs to claimant clinical negligence lawyers over the past year, a rise of 61% on the previous 12 months, its annual report has revealed. Defendant lawyers also saw their costs shoot up 47% to £62m.

CJC warns of MoJ threat to access to justice as Jackson implementation role is revealed
Thursday, 4 August 2011Government plans to reduce the amount of litigation in the county courts by introducing mandatory pre-action directions will undermine the constitutional principle of access to the courts, the Civil Justice Council (CJC) has warned. The news comes as the CJC’s role in implementing the Jackson reforms has also been revealed.

“Overpaid” PI lawyers could make a living on much lower fees, MPs told
Tuesday, 19 July 2011Lawyers are overpaid for cases run through the road traffic accident claims portal and should be able to make a living from a far lower level of fee, MPs were told last week. Nick Starling from the Association of British Insurers suggested that if referral fees were banned, the £1,200 solicitors receive for portal cases could be reduced substantially.
