Implementation of Jackson reforms pushed back to April 2013
Tuesday, 31 January 2012The government has pushed back implementation of the Jackson reforms and the referral fee ban to April 2013, it announced yesterday. However, it knocked back all amendments to key elements of the reforms during a House of Lords debate.

Jackson: should contingency fee lawyers be liable for defendant’s costs?
Monday, 23 January 2012Work is needed to determine whether solicitors who offer contingency fees could find themselves on the hook for a successful defendant’s costs, Lord Justice Jackson said last week. He said a working party might be needed to resolve outstanding issues.

Academic report attacks "excessive and over-zealous" Jackson reforms
Tuesday, 17 January 2012The Jackson reforms are “excessive and over-zealous” in their impact on personal injury work, failing to achieve their core objective of promoting access to justice at proportionate cost, an academic study has concluded. Dr Claire McIvor said the judge’s recommendations “blatantly prioritise the interests of defendants”.

Jackson: litigators should use third-party funders signed up to new code of conduct
Thursday, 24 November 2011Solicitors should advise clients to enter funding agreements with third-party litigation funders that sign up to a new voluntary code of conduct, Lord Justice Jackson said last night. He welcomed publication of the code and creation of the Association of Litigation Funders to monitor compliance with it.

Scrap qualified one-way costs-shifting, says Allianz

LASPO critics ignoring impact of ABSs on changing the legal profession, minister claims
Tuesday, 22 November 2011Lawyers complaining about the Legal Aid, Sentencing & Punishment of Offenders Bill have not considered the impact of ABSs in changing the way the legal profession works, justice minister Lord McNally said yesterday. However, the second reading of the bill raised the possibility of a concession over removing clinical negligence from legal aid and of further regulation of third-party funding.

CMCs will start running – and under-settling – cases to survive, lawyers warn
