Reflecting on 20 years of ATE for DAS
Tuesday, 9 July 2019ATE insurance came into being nearly 20 years ago in the wake of the Access to Justice Act 1999, a piece of legislation which revolutionised the legal aid system in England and Wales. We were one of the first companies to provide the cover and, at first, it was all so straightforward – no initial premium payment required, it was effectively ‘self-insured’, and all of it was written off if the case didn’t win.

Most of us have been there; a shiny product and convincing salesperson, and the price never seems expensive when it’s broken down into 80 years’ worth of monthly payments in a finance deal. Then the next day – remorse. But can we cancel? The answer is often yes, but it can turn on some surprisingly arbitrary points.
