Solicitors risk “huge losses” under Jackson reforms
Thursday, 15 September 2011The national costs management pilot being rolled out next month will put law firms in danger of huge losses, a leading expert has warned. Professor Dominic Regan said costs management will place much greater emphasis and scrutiny to produce detailed and accurate budgets.

Rule committee approves three costs pilots and reverses controversial Carver ruling
Tuesday, 23 August 2011There will be three different costs pilots running from this autumn as the impact of the Jackson report spreads, the Civil Procedure Rule Committee has decided. It has also accepted the report’s recommendation to reverse the Court of Appeal’s highly controversial Carver ruling.

NHS pays out £94m more to lawyers on both sides as costs bill tops £250m
Monday, 8 August 2011The NHS Litigation Authority paid out £195m in costs to claimant clinical negligence lawyers over the past year, a rise of 61% on the previous 12 months, its annual report has revealed. Defendant lawyers also saw their costs shoot up 47% to £62m.

Jackson’s costs management pilot to go nationwide in October
Wednesday, 15 June 2011A pilot project intended to control the costs of civil litigation, born out of Lord Justice Jackson’s reforms, will launch in Mercantile and Technology and Construction Courts nationwide in October following the success of the first stage of the programme in Birmingham.

Law firms can indemnify clients against paying other side’s costs, CA rules
Wednesday, 26 January 2011It is not champertous for a solicitor to indemnify his client against paying the other side’s costs in the event of not finding insurance, the Court of Appeal ruled yesterday. It is thought that law firms may find themselves offering such arrangements more frequently in a post-Jackson/legal aid reform world so as to secure work.

Bad points are a “good reason” to terminate retainer, says Court of Appeal
Monday, 1 March 2010A solicitor has good reason to terminate a retainer if a client insists on putting forward a case and instructing counsel to advance contentions that they do not consider properly arguable, the Court of Appeal has ruled.
