Consumers have benefited from legal reforms but still “lack power”, says report
Friday, 24 June 2011The four years since the Legal Services Act have seen “positive changes” for consumers, but many problems persist, the first ever assessment of the reforms has concluded. The consumer impact report, published today by the Legal Services Consumer Panel, says consumers usually get the outcomes they want and most are happy with the service they receive – although it points out that they have little experience against which to judge this.

BSB: legal aid cuts driving more litigants-in-person and gripes over opposing barristers
Tuesday, 21 June 2011Complaints against barristers by litigants-in-person forced by legal aid cuts to represent themselves are rising fast, according to the Bar Standards Board. Many result from a misunderstanding of the role of opposition barristers. The Justice Bill, containing more cuts, should be published today.

Poor communication tops consumer complaints as LeO reports on first six months
Friday, 17 June 2011Poor communication between lawyers and their clients was “writ large” as a theme running throughout cases brought to the Legal Ombudsman (LeO) in its first six months, the chief ombudsman has reported. It launched nearly 4,000 investigations by the end of March, from more than 38,000 calls.

Here’s something you won’t believe
Sunday, 12 June 2011Complaints are a law firm’s best source of market intelligence. I’ve heard this said countless times in recent years, previously by the Legal Complaints Service and its many forebears, and now by the Legal Services Board. “Many lawyers are missing the chance to learn from substantial numbers of consumers who make a complaint,” said LSB chief executive Chris Kenny last week. It may well be true. But hardly any lawyer believes it.

LSB: law firms failing clients on complaints

Solicitors can discharge barristers’ complaints information obligation, BSB decides

Solicitors repay £10m to miners as compensation scandal nears end
Monday, 7 March 2011Solicitors have repaid nearly £10m to miners who had sums wrongly deducted from their damages, Legal Futures can reveal. The Legal Complaints Service has now closed the last complaint arising from the miners compensation scandal ahead of its formal shut-down this month.

Regulators letting down consumers over complaints, says LSB
Wednesday, 2 March 2011Frontline regulators are letting down consumers by failing to collect information on how lawyers are handling complaints, a review by the Legal Services Board has concluded. This would make it difficult for them “to identify systemic issues and adopt a targeted approach to regulation”.

Consumers back complaints publication but could misuse information, research finds
Thursday, 24 February 2011Consumers believe that a lawyer who has provided a bad service should be “named and shamed”, research released today has found. However, there are signs that consumers are likely to use published information “in a way that may be at odds with the Legal Ombudsman’s reasons for publication”.

Chambers not complying over complaints as SRA tells solicitors they need not help
Friday, 18 February 2011Four out of ten barristers’ chambers have flouted a regulatory requirement to notify lay clients of their rights to complain about poor service, amid a continuing furore over difficulties in complying with the scheme, it has emerged. Meanwhile, the Solicitors Regulation Authority has confirmed that solicitors are under no obligation to assist barristers in contacting clients directly in order to meet their obligations.
