CoP – Statutory Will Research
When the court of protection rules someone lacks the capacity to handle their own affairs, there may be a requirement for an appointed deputy to make a statutory will application to determine how the estate will be dealt with.
The typical example for submitting a statutory will application is where a client has not previously written a will outlining their wishes on how their estate should be administered.
However, even if a Will exists, there may be situations where an application to court would still be made due to a material change in the client’s circumstances, such as:
- An increase or decrease in the estate value
- Beneficiaries named in a pre-existing will having predeceased
- Beneficiaries named in a pre-existing will having received substantial gifts and adjustment is sought
- Tax planning reasons
- Recompensing a legatee due to disposal of a specific asset

Training events – FREE to attend
Finders International have been running conferences for Private and Public deputies for over 5 years and continue to make these free to attend.
As we are members of the Continuous Professional Development (CPD) Certification Service, attendance at these events is recognised as educational learning that conforms to CPD guidelines.
To end a fantastic year of events, we have our Private Deputies Conference, which takes place on 10 November 2022 at 41 Portland Place, London, W1B 1QH.

Deputyship Development Days
This year we have also been running Deputyship Development events to assist Public and Private deputies. Our last event for the year took place on the 13 October 2022 in York and brought in over 60 delegates online and in person. We were joined by the DWP and representatives from Universal Credit, Clare King, Head of the Court of Protection & PI Trusts at Clarion and Ben Slater from Nellie supports.
